Terms of Service

These Terms of Service (“Terms”) govern access to and use of litigation support and related services provided by Nationwide Legal, LLC (“Nationwide,” “we,” “us,” or “our”). By accessing or using Nationwide’s services, you agree to be bound by these Terms.

These Terms incorporate by reference Nationwide’s Privacy Policy, Security Policy, and Data Deletion Policy, which together describe how information is handled, protected, and retained.

1. Scope of Services and Role

Nationwide provides litigation support and court-related fulfillment services, including but not limited to e-filing coordination, physical court filing, service of process, courtesy copy delivery, records retrieval, investigations, subpoena support, appearance counsel coordination, and related litigation support services (collectively, the “Services”).

Services may involve manual coordination, automated systems, or a combination thereof, and are performed strictly in accordance with customer instructions.

Nationwide acts solely as an independent intermediary and service facilitator between customers and third parties, including courts, clerks, government agencies, service providers, and independent contractors.

Nationwide is not a law firm, does not provide legal advice or legal services, and does not represent any party in any legal matter.

2. No Control Over Courts or Third Parties

You acknowledge and agree that:

    • Courts, clerks, agencies, and third-party providers operate independently of Nationwide.
    • Nationwide does not control court systems, filing portals, acceptance criteria, processing timelines, or judicial outcomes.
    • Nationwide does not guarantee filing acceptance, service completion, turnaround times, or legal results.
    • Delays, rejections, errors, or system outages caused by courts or third parties are outside Nationwide’s control.
    • Nationwide’s obligations are limited to making commercially reasonable efforts to transmit, submit, or coordinate Services based on the information you provide.

3. User Responsibilities

You are solely responsible for:

    • Providing accurate, complete, and timely information.
    • Selecting the correct jurisdiction, court, case type, parties, and documents.
    • Ensuring compliance with applicable court rules, deadlines, and formatting requirements.
    • Reviewing submissions, confirmations, notices, and communications.
    • Monitoring filing status and court communications.

Nationwide may rely entirely on the information you provide and has no obligation to independently verify accuracy, completeness, or legal sufficiency. Failure to review confirmations or communications does not relieve you of responsibility for deadlines or compliance.

4. Authorization to Act

By submitting an order or request, you authorize Nationwide to:

    • Act as your limited agent solely to facilitate the specific Services requested.
    • Transmit documents and information to courts and third parties as necessary to perform the Services.
    • Pay court, government, or third-party fees on your behalf when applicable.

This authorization applies only to the specific transaction submitted and terminates upon completion or cancellation of that transaction. This authorization does not create a fiduciary relationship, partnership, joint venture, or attorney-client relationship.

5. Fees and Payments

    • Fees are disclosed at the time of order or pursuant to a separate written agreement.
    • Court, government, and third-party fees are non-refundable once incurred. Nationwide service fees may be refundable only if Services have not commenced.
    • You remain responsible for all fees, costs, and expenses arising from incorrect, incomplete, or inaccurate information you provide.
    • Invoices are due upon receipt unless otherwise agreed in writing. Nationwide may suspend Services for non-payment.

6. Rejections, Corrections, and Resubmissions

If a filing or service is rejected or requires correction:

    • Nationwide may notify you when practicable and provide available details.
    • Resubmission requires your authorization and may incur additional fees.
    • Nationwide is not responsible for missed deadlines caused by rejections, court delays, resubmissions, or third-party actions.

7. No Warranties

Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Nationwide disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law:

    • Nationwide’s total liability arising out of or related to the Services shall not exceed the fees paid for the specific Service giving rise to the claim.
    • Nationwide shall not be liable for indirect, incidental, consequential, special, or punitive damages.
    • Nationwide shall not be liable for lost profits, lost cases, sanctions, penalties, or adverse legal or procedural outcomes.

9. Indemnification

You agree to indemnify, defend, and hold harmless Nationwide from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

    • Your use of the Services.
    • Information, documents, or instructions you provide.
    • Violations of court rules, laws, or third-party rights.
    • Disputes related to your legal matters or proceedings.

10. Suspension and Termination

Nationwide may suspend or terminate access to Services for misuse, fraud, non-payment, legal or regulatory compliance concerns, or abuse of court systems.

Termination does not relieve you of payment obligations for Services performed or fees incurred prior to termination. Data handling following termination is governed by Nationwide’s Data Deletion Policy.

11. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Exclusive venue lies in the state or federal courts located in Los Angeles County, California.

12. Modifications

Nationwide may update these Terms from time to time. Material changes will be posted with an updated effective date. Continued use of the Services after such changes constitutes acceptance of the updated Terms.
